"Komsomolskaya Pravda" has already told about the beginning of an amazing story. Human rights defenders united to defend the owners of a small family café in Voronezh. They say that a criminal case was opened against them under the article "drug trafficking", they humiliate, poison, extort money. The father of the family languishes in jail, the daughter was released on bail … And all this for simple pies with poppy seeds, which were sold in a cafe. We also decided to help the unfortunate businessmen. And we went to Voronezh. However, in reality, everything turned out to be far from the picture painted by human rights activists and opposition newspapers.

AND NOW - AS REALLY

Once upon a time there were seven brothers and sisters. Nina, Maria, Natalia, Victor, Tatiana, Irina … At least three of them worked in trade and accounting, and in the 90s they started a business: kiosks at the bus station and a diner in an ugly, unsettled residential area. Everyone kept to each other: two sisters worked in a cafe, two, weaker ones, were taken as cleaners; husbands helped to make repairs, children entertained guests at banquets.

A mighty bunch, family, fist. Seven Simeons. How they survived in the 90s - I won't even fantasize: “We worked for taxes and for salaries,” said Maria Polukhina (according to the investigation, the head of the criminal group and Zhenya's mother, whom we introduced you to in the first part of the investigation).

And since 2006, the "theme" has gone. Poppy with "garbage" was suddenly brought into the country: boxes, pieces of stems, straws. Poppy is a cunning plant: seeds are harmless, but in everything else - alkaloids, a drug.

The "theme" went all at once, from the territory of Asian countries, the "dirty" poppy was imported through the Novorossiysk customs in trains: in quantities completely obscene to bakeries. The proportion is approximately the following: a normal bakery needs fifty kilograms of poppy per month, and the region receives twenty tons …

It is not surprising that the “poppy” drug addiction in the Kuban, for example, at some point amounted to one hundred percent. It is easy and cheap to isolate an opium solution from a "dirty" poppy … Our seven Simeons "caught" the "theme" around 2008. By the way, no one considered it a drug trade: I remember very well how narcologists and the Federal Drug Control Service gathered round tables on the topic: "Poppy is a food product, we are helpless, what should we do?" Werewolves in epaulets were cutting coupons (narik, you can see him), the FSKN operatives were furious. Governors made arbitrary decisions to ban poppy (which contradicted federal law and were successfully challenged in court by drug dealers).

Circus? No - our recent history …

At some point, desperate to resolve the issue through customs (so that the "wrong" poppy was wrapped at the border), the drug control decided to break judicial practice: to hit the end sellers. So what if poppy is a food product? After all, straw and opium are included in the list of illegal drugs. Someone deliberately mixes them abroad with poppy seeds (there is so much garbage that it is impossible to bake pies out of such rubbish) - but maybe with buckwheat. So, you just need to make an examination and prove that the mixture is a disguise for a drug, and businessmen are aware of the black business …

The Polukhin were in the know. One of the drug addicts said that the very same Zhenya asked her sympathetically: is her child suffocating from "sour"? "Sour" is, just in slang, one of the ingredients for distilling opium, available on the open market …

We worked harmoniously. The sister-owner of the tent at the bus station was the first to meet drug addicts: she released a test package, gave the phone number to the eldest, Maria (as per the case file). Maria left the house by the code word; the drug was found at her home, at her sister's from the bus station, at her sister Nina's. In "Ochag", which drug addicts called among themselves "washer", the poppy lay under the counter, packaged in packages, sold by the saleswomen, the administrator Zhenya and, sometimes, the cleaning ladies money).

The family was on their phones: “The cops are there right in front of the pavilion. So far, so no, no, do you understand?”- a common conversation, how can you cope with your health. When I read kilometers of wiretapping, I was sick of hypocrisy. Dozens of coded messages: "Sunny, come out for a minute" - that means one packet, or: "We'll jump into the Ochag now, we have two shashliks" - two packets; and sometimes the Polukhins got confused in their conspiracy, and it went something like this: "We need a Baltika -" Nine? " - "Ten!", - "Ah! Do you need ten kilograms of potatoes? "-" Yes, yes, yes."

And the worst thing is the wiretapping of Nina Chursina (sister of Maria Polukhina, wife's aunt). A drug addict named Messing, who later called from the zone and offered to change his readings for money, day after day brings her, for a drug, for sale: an alarm clock, a filter for an aquarium, a flash card … There is a cactus in a pot. A phone with a broken edge. Another phone. Another phone. The floor vase … do you understand? Polukhin was not charged with buying stolen goods. But I can still see the frenzied faces and desperately shining eyes of drug addicts' parents, from whom everything is being scraped out of the house. Even in spite of the broken edges. And how nagged me from the meat with cheese and mushrooms eaten in the Ochag, when I read happy family talks: “Mom, Messing attracted such a high-quality mixer, let me put it on?” -f February bought a gift? Messing brought a jacket, she was right on him … they put it on almost three times … " The background goes: "Kolya, well, eat a banana, you need it."

Because the mafia is a "family". "Fists". Polukhin are such "fists". Strong foundations, identical in face, holding each other, prosperous, hard-working. They constantly rub tables in their cafe, constantly take out pots for some grandmothers who bequeathed them an apartment for care (and look after them conscientiously, the wiretapping does not lie). They do not disdain any work that can bring money. The rubles earned on the poppy are also invested in new buildings, and these apartments: for a sister who is disabled from childhood, for the son of a sister who died, and so on. Woe, grief poppy. The wing covered this family and millions of others.

HOW BLACK TO REPRESENT WHITE

The most interesting thing remained: to understand why for people who were fully exposed, with five tons of poppy in the garages of friends and relatives (all testimonies of all witnesses were received), with labeled money (the Polukhin was detained only after a test purchase in Ochag), with an examination and drug addicts, confirming in chorus: in the confiscated there is a lot of "foolishness" … in a word, why for these, in general, ordinary defendants such not sickly forces stood up as the Public Chamber of the Russian Federation? Committee "For Civil Rights" and personally human rights activist Andrei Babushkin? Home opposition newspaper in the country?

Babushkin made Zhenya Polukhina (the one who speaks on the wiretap: “I’m sitting, I twist the packages”, who was “clapped” at transactions not only by the Federal Drug Control Service, but also by the extremism department of the Voronezh Internal Affairs Directorate, and Belgorod, and all red-handed) as his representative in Voronezh! In non-state circles, the Polukhins were recognized as victims of police arbitrariness, the opposition press spent five years hammering essays on the topic: “Poor pies merchants”, the Federal Drug Control Service gathered round tables with merchants' lawyers and discussed: “Poppy: food or evil?” …

At first, the defense successfully fell into a vein of complete general ignorance. Everyone ate buns with poppy seeds, and the hidden drug was a new thing (spice, which was also sprayed on any dry grass, came to the country later) …

However, I'd rather show you how the defense worked.

On March 1, 2010, a decision was made to initiate a criminal case - this is absolutely the first document in the subsequent forty-five-volume epic.

Polukhin Aleksandr Petrovich, retired colonel, former head of the tactics department of the Voronezh Higher Military School, writes a complaint to the court: "I ask you to declare the decision illegal and unfounded."

Court: refuse. Polukhin files a complaint with the court … And such rubbish - all forty-five volumes. Polukhin complained to the court about the decision to investigate the case by the investigating group, declaring a challenge to the candidacy of the head. He complained to the central office of the Federal Drug Control Service, to the head of the investigative service, Kineshman, and, next, to Kineshman. The Voronezh District Court was lying about with laughter: Polukhin, consistently, demanded that the identification be canceled, that a criminal case be opened against the experts, that an examination privately carried out by lawyers and the investigator was added to the case file, completely unnecessary, forcing the investigator to conduct a new examination, moreover, on the issues that the defense wants, and so on … And all the other members of the litigant's family did the same. In my opinion, a comparison with annoying flies is appropriate here. Unable to interfere with the case (because the investigation was conducted, on the whole, objectively), they could itch and bite, constantly summon the investigator to court, write to the Public Chamber and send telegrams to the head of the Federal Drug Control Service Ivanov, haunt and demand the strict fulfillment of all formalities, to incite public opinion against the dominance of formalities, in a word - to tire to exhaustion.

In the end, the court began to answer Polukhin that he, being accused of a crime, is actually trying to lead the investigation (the absurdity of this situation has nothing to compare with) … But we now know this. And all these years, the opposition media skillfully painted a picture of the persecution of entrepreneurs, they called black white, the truth about the drug trade was completely hushed up, the flaws of the investigation were blown up to the skies. The "experts" taken from somewhere by the Moscow human rights lobby stated that there is always a drug in poppy seeds, that the requirements of GOST, which completely exclude the admixture of poppy straw in grains, cannot be fulfilled, that the Polukhin's poppy is PURE …

As far as I know, these "experts" act on all poppy cases like a blueprint. As far as I know, they are already being prosecuted for perjury. But what the cost of this investigation to the Russian law enforcement system, with such attention from civil society in its worst sense, is difficult for me even to assess.

“This one is very good, with musarushki!”, The drug addicts praise the “pure” polukhinsky poppy on the wiretap and share with the investigator that the drug, it turns out, cannot be cooked from any raw material. It is impossible to get out of the shop poppy, sealed in bags, but from the “Ochagovka” poppy seed it always came out … And the “Ochagovka” ones also asked the drug addicts: which batch is better? Marketing is the engine of commerce …

FAILURE OF THE OPPOSITION

Deception, deception all around.

Zhenya is deceiving: there is not a word in the criminal case that she manually mixed opium with poppy seeds in the garage (if this was done, then abroad, and the Polukhins are accused only of trade). Why lie that the girl, according to the investigation, dried the drug with a hairdryer? I do not understand.

The opposition newspaper is deceiving, which seems to be proud of the traditions of journalistic investigation, but whose correspondent did not even bother to listen to the audio recording of the court session! It is not the prosecutor and the judge who are rude to Polukhin and trample them underfoot, but the accused POLUKHIN, sitting in a cage, behaves obscenely, calls the prosecutor to “you”: “He is presiding, you see! He appointed himself the chairman! "- or loudly yells:" You will find yourself behind bars, yes! Because I am not a criminal, but you are a criminal! I'll explain everything that you did on the case! The only person who falsified … "(for those who do not know: the prosecutor does nothing special in the case, he defends the position set forth by the investigator. - Ed.).

On July 7-8, a verdict is expected to the owners of Ochag - but, in fact, a verdict to that very notorious civil society: dishonest journalists, human rights activists and other public who consider themselves to be the opposition, which has supported outright villains for five years, broadcast any complete nonsense, if only shit on the authorities, put a needle in the leg of the law enforcement system.

You guys have failed. This is a complete failure. And life goes on. "Salt" - is written on the corner of the house near the deserted "Hearth". And the phone number is listed. When these merchants are taken by the gills, will the aforementioned public rise to their protection?

PS The only thing that I am ready to agree with the Polukhin accused of drug trafficking: the investigation was obliged to attract not only them, but to track the entire path of the drug poppy from the border on the waybills, since it is obvious by wiretapping which warehouse it was taken from, for how much, etc. And now a paradoxical situation is emerging: the state itself allowed the poppy into the country, cleared it itself, did not interfere with the sale of wholesale lots … And only retailers will sit down.
