From time immemorial, a small people, the Shors, have lived on the territory of Western Siberia, there are only a little more than 12 thousand of them left. When the Shors realized that the local authorities treated them in much the same way as the American colonialists treated the Indians, they filed a complaint with the UN. I talked about this in my previous article. "The UN is concerned about reports of the genocide of the Shors in the Russian Federation!"

Commentary on Art. 357 of the Criminal Code of the Russian Federation:

1. The main object of the crime is social relations that ensure safe conditions for the existence of life and health of national, ethnic, racial and religious groups. An additional object is the life and health of people, groups defined by law (as a whole), human rights and freedom.

2. The article commented on was formulated and included in the Criminal Code on the basis of and pursuant to the Convention on the Prevention and Punishment of the Crime of Genocide, signed in New York on December 9, 1948, which states that the entire civilized world condemns genocide, that genocide regardless of whether it is committed in time of peace or war, is a crime that violates the norms of international law and against which the contracting parties undertake to take preventive measures and punish for its commission.

3. A national group of people is understood as a historically formed group belonging to a particular nation, which is characterized by a common territory, common language, economy, national character, culture, customs, traditions, and other characteristics that distinguish it from other groups.

An ethnic group (ethnos) is understood as a historically formed type of a stable social group of people, consisting of people of a certain tribe, people, nationality, nation, which is characterized by compact settlement in a certain territory, features of language, religion, culture, way of life, customs, traditions

A racial group means a historically formed group of people, united by hereditary biological external physical characteristics that distinguish it from other groups in terms of skin color, hair, eyes, outline, face shapes, proportions and structure of the nose, lips, head, body and its height and other features. … There are four main races: Australian, Eurasian, Mongoloid (Asian-American), Negroid (Negro).

A religious group refers to a certain group of people who profess any common religion, which, as a rule, differs from the dominant, dominant official religion of the majority of the population of the territory where this group lives.

4. The objective side is characterized by the actions specified in the law aimed at the complete or partial destruction of a national, ethnic, racial or religious group of people: 1) the murder of members of this group; 2) causing grievous harm to their health; 3) violent obstruction of childbirth; 4) forced transfer of children; 5) forced resettlement; 6) or other creation of living conditions calculated for the physical destruction of members of this group.

5. Murder as a method of committing genocide is the deprivation of the life of members of a certain group precisely for the purpose of destroying in whole or in part the representatives of such a group. This purpose distinguishes genocide from murder as an independent crime. The killing of members of a national, ethnic, racial or religious group as a method of committing genocide consists in the deliberate infliction of death, and this murder differs from the “usual” purpose and direction of actions for the complete or partial destruction of such a specific group. Additional qualification of actions under Art. 105 of the Criminal Code of the Russian Federation is not required.

6. Similarly, it is considered as a way of committing genocide and causing grievous bodily harm.

7. Violent obstruction of childbirth in genocide may consist in various violent actions against a national, ethnic, racial or religious group aimed at preventing or limiting the birth of children - castration, sterilization, prohibition of pregnancy, termination of pregnancy, prohibition of having children or limiting the number of children, etc.

8. Forced transfer of children during genocide can consist in various violent actions against a national, ethnic, racial or religious group, aimed at forcibly taking children from their parents or other guardians, and transferring the removed children to other unauthorized persons, organizations, forced displacement, the relocation of children from their place of residence to other places, including the return to slavery. Compulsory forms of transfer of children are not established in the law, such can be donation, sale, exchange, other compensated or gratuitous transactions. Additional qualifications under Art. Art. 126, 127.1, 127.2 of the Criminal Code is not required.

9. Forced resettlement in the event of genocide of a national, ethnic, racial or religious group may be in their forced relocation, moving from places of permanent residence to another place of residence, to another territory, including abroad.

10. Other creation of living conditions calculated for the physical destruction of members of a national, ethnic, racial or religious group, during genocide, may consist in various methods aimed at their complete or partial destruction - contamination with radioactive, chemical, biological, toxic materials of the area, the natural habitat of such groups, in connection with which people of these groups cannot live there or will live there with danger to life and health, failure to provide humanitarian aid, failure to carry out recovery work in emergency, natural disasters, which leads to hunger, the spread of disease, the extinction of groups due to the lack of life support facilities, etc.

11. Genocide is recognized as a completed crime from the moment of committing at least one of the specified actions.

12. The subjective side of the crime is characterized by direct intent, special purpose - complete or partial destruction of a national, ethnic, racial or religious group.

13. The subject of the crime is a sane natural person who has reached the age of 16 years. According to Art. 4 of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, perpetrators of genocide are punished, regardless of whether they are constitutionally responsible rulers, officials or private individuals.

So what do we have?

1. Objective side:

In Western Siberia, over the past few years, the following have taken place in relation to the Shors: a) multiple attempts to forcibly resettle them from their places of permanent residence to other places of residence; b) intimidation and threats to persuade them to move to other places of residence; c) the creation of unbearable living conditions in the place of compact residence of the Shors, contributing to the physical destruction (extinction) of members of this ethnic group.

The fact of the extinction of the Shors was noted even in the world encyclopedia, in the article "National composition of Russia".

The Shors are the 72nd largest nation of Russia. In 2002 there were 13975 of them, and in 2010 there were already 12888 Shors. For 8 years, 7, 78% of the Shors have become extinct - the act itself is blatant

Now about subjective side of the crime genocide. As written in the law and the commentary to it, the subjective side of the crime "is characterized by direct intent, a special purpose - the complete or partial destruction of a national, ethnic, racial or religious group."

In the case of the creation of unbearable living conditions for the small ethnic group "Shors" in the place of their settlement on the territory of the Kemerovo region, there was this very direct and conscious intentburdened by the circumstances that, according to the residents of the Shor village of Kazas, they were periodically intimidated, offering to leave their homes, and when the attempts to intimidate had no effect, the attackers sent in began to set fire to the houses of the Shors. Moreover, the local police established that deliberate arson of houses took place in Kazas! In total, 5 houses were burned in the Shor village in the autumn-winter period of 2013-2014, while none of these crimes were solved!

Thus, there is a crime that has all the signs of genocide!

The fact that this crime lasted a very long time, for the guilty party excludes the option of acquittal due to "unconscious intent", they say, "we did not know what we were doing!" …

Even before the opening of the Kiyzasskiy open-pit mine, the newspaper Krugozor in Kuzbass No. 12 (1225) dated March 28-April 3, 2013, published an open letter to the Governor of the Kemerovo Region from residents of the villages of Myski and Vladislav Tannagashev. Their fears came true:

Thus, those who started coal mining around the village of Kazas could not help but know that the Shors live there, representatives of a small ethnic group, which is characterized by compact settlement in a certain territory, and that the area of their settlement includes the nearby landscape with their sacred mountain.

For example, the Jews have their own sacred mountain - Zion, where, according to an ancient legend, the prophet Moses visited and where he received the Torah, a sacred book for the Jews, into his hands.

The Shors had exactly the same sacred mountain near the village of Kazas. They gathered there annually, made sacrifices to their patron spirits, and organized their pagan holidays. In 2014, alien coal miners unceremoniously blew up the sacred mountain of the Shors to make a so-called "coal mine" there! What it is, you can see in this photo.

Another circumstance aggravating the guilt of the coal oligarchs and indicating that on their part there were deliberate actions, "aimed at the partial or complete destruction of an ethnic group as such by forcible resettlement or other creation of living conditions calculated for the physical destruction of members of this group …" is the fact that (when an ecological disaster occurred in this area) coal oligarchs did not bother using their super profits to build a new settlement for the Shors in an ecologically clean region of Western Siberia, and, according to the inhabitants of the dying village of Kazas, they were offered a piece of wetland where they had to build new houses for themselves on their own. The Shors, naturally, considered such a proposal nothing more than an insult and mockery!

Moreover, the price of the issue for the coal oligarchs - to build new houses for hundreds of Shors in an ecologically clean (not yet polluted by anyone) place - was several tens of millions of rubles! Only a few units of heavy quarry equipment cost so much!

The reluctance of coal oligarchs to spend even such a small amount on local aborigines reveals the subjective side of the crime they committed, their "internal mental attitude to the socially dangerous act committed by them", which can be called misanthropy (contempt for people not of their circle or their blood).

Thus, we have a historical and legal fact: on the territory of the Russian Federation, a blatant crime in cynicism and scope was committed against a small ethnic group - the Shors. At the same time, the perpetrators of this crime have not yet been punished!

I have personally lived in the Shor village of Kazas for over twenty years and am not only a victim, but also a witness to the crimes of coal miners-oligarchs against the Shors. For the fact that at a meeting of the inhabitants of the village I had the courage to call these crimes genocide, the coal oligarchs and the local authorities dragged me to court. In the regional court, the judge, having familiarized himself with this case and embarrassed, asked me incredulously, “You presented evidence that for a long time the water in the Kazasik River and the air in the village were poisoned, people were intimidated, houses were burned … criminal proceedings were instituted on this matter. And that the perpetrators have not been identified?"

Honestly, after her question, I fell into a slight stupor. And really why weren't the guilty ones found? - flashed through my head. But I just bleated to the judge in response: "Nooo!"

Exactly one year has passed since the consideration of the Casas case at the UN. During this period, the position of the Shors only worsened. An administrative case was opened against Yuri Bubentsov, followed by five days of arrest for a post in contact. We were forced to apply for political asylum in Europe because of the total persecution and threats against us and our children:

In July 2018, the Kazassians were again offered money to sell their already empty plots. The Kazassians again refused due to the fact that throughout all these years they have put forward clear, definite requirements:

1) Create territories of traditional nature management in the Kemerovo region (today in Kuzbass there is not a single TPP, although the Federal Law allows the creation of such territories).

2) Restore the status of the Chuvashinsky National Village Council within the boundaries of 2002.

3) Conclude a trilateral open-ended agreement between the residents of the village. Kazas, JSC "UK Yuzhnaya" and the Myskovsky municipal district "On the preservation of the cemetery and the creation of unhindered access for residents to the cemetery in the village. Casas ".

4) Include in the register of cultural heritage objects of the Shor people the sacred mountain Karagai-Lyash (Lysaya), located on the territory of the village. Casas.

5) Buy comfortable apartments of JSC "UK Yuzhnaya" for orphans, former residents of the village. Casas.

6) Establish decent compensation for each land plot and residential building with buildings.

7) Create a commission to investigate crimes and violation of rights in relation to residents of the village. Kazas is the traditional residence of the indigenous small people of the Shors.

8) Provide comfortable housing for the residents of the Kazas settlement who found themselves homeless as a result of the so-called "resettlement" that took place in the Kazas settlement from 2012 to 2015.

9) Build a new village at the expense of coal companies operating in the territory of the Myskovsky urban district in an ecologically clean place, in the place where the residents of the village indicate. Casas (at least 50 houses).

10) Create a permanent commission for environmental monitoring in the Myskovsky municipal district with the obligatory participation of members of the Myskovsky city public organization "Revival of Kazas and the Shor people."

In addition, the organization offered:

- The Kemerovo Regional Council of People's Deputies to adopt a regional Law on Subsoil Use, taking into account the free prior and informed consent of the indigenous peoples of the Kemerovo Region.

- To restore the department of Shor language and literature at the Novokuznetsk Institute (branch) of the federal state budgetary educational institution of higher education "Kemerovo State University".

A year ago, the head of the FADN, Igor Barinov, during a UN meeting, promised the Shors to sit down at the negotiating table, but today, having tarnished the honor of the Russian officer, Barinov has not kept his promise: the hussar gave his word, the hussar took it."

The problems of the Shors are the problems of the whole of Russia. First of all, the Russians, whose genocide is in full swing and is still poorly visible due to the large number of people. Due to their small number, the Shors were the first to take the dangerous line. Minerals are mined wherever they are found. This is fine. Another question is how this happens. The miners do not care what the aborigines call themselves and how many centuries they have lived on the land, which, by naivety, continue to consider their own. Therefore, the unenviable position of the Shors today is the same unenviable position of the Russians tomorrow, if no measures are taken to curb the predatory Western colonialists. Without saving the Russians, the Shors will definitely die. Only the Russians are able to resolve positively the question of their survival. It is necessary to take on the main link, that is, to save the Russians. But starting today to fight for the Shors, we will be able to work out some technologies to save ourselves. The experience will be very useful, first of all, by the fact that in a joint noble cause people unite, there is a unity, which is sorely lacking today. As a result, the strength of the people increases many times over. So by helping the Shors, we are helping ourselves! And this is the main point. I don’t trust the UN. Everyone knows: whoever feeds a girl dances her. The UN is being fed by the Americans; they will only pursue their own selfish interests. Therefore, I would not really count on this American "girl".
