Everyone born in the USSR could watch the bullfight of reason and law under the code name "Ennobling of the territory":

New buildings always end with landscaping and footpaths. Builders traditionally lay them where they see fit. Then the residents trample paths where it is more convenient to walk. Then begins the BORB of house managers and pedestrians, where the first ones are dug up, fenced off and planted, and the second ones climb over, demolish and trample.

The idea, great in its inaccessibility, - first to let the population trample the paths, and then precisely to asphalt them - seems to house managers and builders blasphemous in showing submission to the desires of some kind of plebs …

Paths in new buildings are a ready-made textbook on the topic “how the state should and should not behave in the economy,” where asphalt paths, various hedges and signs “do not walk” are the very laws by which civil society lives.

“Law (legislation) is not capable of creating new relations between people, but only to consolidate existing ones,” they will tell you already in the 1st year of any law faculty, so that later, having received a law degree, you wondered the rest of your life how the designers of laws are trying this simple law ignore. Well, spilled house managers tirelessly digging paths trodden by the population and trying in vain to launch the flow of people along the routes projected by whom and by whom, it is not clear how, which in no way correlate with the real direction of movement.

Well, now, after such a long preface, let's get down to such an interesting question as tax legislation and tax practice, and how do they differ?

How do people trample paths and climb fences in the economy?

More precisely, how is taxes collected on the spot? Omitting such a sparkling process as tax planning, where each point of practice can be illustrated with anecdotes, let's go directly to the collection of taxes, which begins when the regional head of the tax service is sent a collection plan.

The regional head of the tax service, having looked at the numbers lowered from above, traditionally swears, comes up with juicy pseudonyms for higher comrades, and then summons solvent vassals and begins to agree on who and how much of them will bring tax revenues from them.

Since no one established the rules of this trade, no procedures were prescribed, and the very fact of such an "agreement" has bad signs of corruption, it goes very differently - depending on the creative abilities of the contracting parties, their theatrical talents, the skills of the Bolsheviks-underground workers and brutal arrogance, which is known to be the second happiness.

In the end (it’s necessary to live somehow), the parties come to a consensus, expressed in absolute figures, which should be poured into the treasury monthly and quarterly, delighting the higher comrades of the head of the regional tax authority with the correct figures in the reports and granting him and his vassals some kind of calmness for a while.

How do tax rates and the entire tax code relate to the described tax practice? Exactly the same as family law has to real relationships in the family. Have you ever seen spouses sort things out while holding the Family Code in their hands? Okay, so to simplify the question, who even knows about the existence of such a code?

Just like the family code is used in everyday family life, tax legislation is used in the practice of filling the budget with real money. This does not mean that it is not used in any way. Used, but not at all the way you think it is.

Tax legislation ghostly looms behind the backs of tax priests, like a certain sword of Damocles, ready at any second to descend on the heads of the recalcitrant. At the same time, the sword itself and its priests, in order to create the correct atmosphere of "stand-fear", should look stern and alarming, like a whistle in the night, pronounce incomprehensible words, make mysterious passes, and in general, with all their appearance, demonstrate that "bargaining is inappropriate here", and "revenge" for disobedience will be inevitable and furious …

Based on the foregoing, the tax legislation itself should be as complex, confusing, contradictory and inaccessible as possible for an ordinary mortal, whose job is a pig - "lie-lie and two-quietly", and not interfere with the priests to perform sacred rites to free his pockets from sins and passions high life.

True, with the introduction of universal literacy, among the plebs there are copies that have overcome the entire tight text of tax legislation, including comments and judicial practice, as well as those who have the opportunity to invite their priests to work, often from among the "former" who arrange scientific disputes, waving in-house instructions and generally behaving disloyal.

But on the whole, the system works … more precisely, it worked, and only recently it began to give obvious failures, like any mechanism, the action of which is based on shamanism, and not on common sense. And here it would be to turn back to the spells, and to the front of the electorate and honestly admit that the systemic crisis is called so because it cannot be cured within the framework of the existing system …

However, “the mice cried, squeaked, but ate the cactus,” because the existing system of innuendo, checks, and balances has long turned into an independent industry in which so many experts, stalkers, providers and other specialists in the parallel world have settled down and thrive. a critical mass will crush any common sense with its administrative and financial resources.

This critical mass of priests can dissolve from the quasi-economy only in one case - with a multiple reduction in the food supply, which is now happening, causing funny reform projects, the main goal of which is to preserve the existing "status quo", which makes no sense to quote and describe, since there can be, by definition, no clear justification for both the 1% tax rate and the 99% tax rate.

In general, debit and credit can never, in any way, and nowhere converge, in which absolutely specific and precise figures of spending on social services, defense and infrastructure are balanced by a percentage of the unknown profit of an incomprehensible number of taxpayers.

Do you know what is the most popular explanation for the increase in the tax rate today … well, for example, from 10% to 11%? "Because 10% is not enough …" At the same time, an elementary and naive question: "Where can a taxpayer earn such income that his tax deductions would be enough?" - for some reason, the designers of modern tax legislation consider it an insult. By the way, they consider the question exactly the same insult: “Why take taxes from state employees, who themselves exist for taxes?” … I generally keep quiet about taxes on pensions, because I think it is obscene …

In the process of such a cut-off, all this variety of unreasonable rates and discounts will go into oblivion, and there will remain a civil agreement between the taxpayer and the state, according to which the first undertakes to pay a very specific amount for the maintenance of the second, and the second - to protect, provide comfort and maintain the first in case of his incapacity. And everything else - which has neither a logical nor a technical and economic justification, will be eliminated or quietly wither away by itself, like alchemy, astrology and other sorcery, because nature strives for perfection, and perfection is the absence of unnecessary things.

As soon as political economic and legislative thought moves in this natural-natural direction, solutions to currently unsolvable problems will immediately become apparent, for example, expanded reproduction of the population with a drop in fertility, the place and role of the family in the modern urbanized world, and even such a sore subject as decent pension provision. in an aging population, which we will discuss in detail in the next chapter …

In the meantime, do not waste time - read the current legislation and highlight the places where it directly contradicts or runs parallel to reality. I promise that as a result you will agree that "Gary Potter" is not the most awesome fantasy … And do not hesitate to call absurdity absurd, because the more often you call things by their proper names, the closer and more understandable the methods of transition into reality will be.
